TERMS & CONDITIONS

For good and valuable consideration, the receipt and legal sufficiency of which is hereby acknowledged, the Customer hereby grants Singapore-Photographer.com (the "Company"), the Company’s assigns, and those persons acting with the Company's authority and permission, the right to document, create or modify photographs/videos and other still and/or moving images (in all formats) and other graphical depictions incorporating the Customer's likeness, in any and all media, whether now known or hereafter created (the “Content”).
The Customer gives the irrevocable and unrestricted right to use and publish photographs taken by the Photographer, which may include my likeness and/or any other proprietary information, for commercial, promotional, advertising, and any other lawful purposes.
The Customer understands and agrees that the photographs may be used in various mediums, including but not limited to print publications, websites, social media, and any other medium or format now known or hereafter developed, without any further compensation, consideration, or notification.
All rights in and to the Content, including the copyright, are and shall remain the sole property of the Company, free and clear from any claims by the Customer or anyone acting on the Customer's behalf. The Company's rights include, but are not limited to, the rights, in perpetuity, to: Use, re-use, publish, and re-publish the Content; Alter, modify or otherwise change the Content in any manner the Company desires; Combine the Content with textual matter and/or with other pictures and/or media; and, Use the Content for illustration, promotion, art, editorial, advertising, trade, publishing, or any other purpose whatsoever.
The Customer releases, discharges, and agrees to hold harmless the Company, the Company heirs, legal representatives and assigns, and all persons acting under the Company's authority or those for whom he/she is acting, from any liability by virtue of any use of the Content or any changes or alterations made thereto.
The Customer warrants that they are of full legal age and have the right to contract in the Customer's own names. they have read the above authorisation, release and agreement, prior to its execution, and they are fully familiar with the contents thereof. This release shall be binding upon the Customer and the Customer's heirs, legal representatives and assigns.
The Customer agrees to be responsible to secure access to areas for the Company to operate its services on. For overseas assignments, the Customer will be responsible for all liaison and fees involved, including and not limited to accommodation, transportation, visas, fines and access rights.
The Customer agrees to indemnify the Company and save it harmless against any and all liabilities, including judgments, costs and reasonable counsel fees, for anything done or omitted by the Company in the execution of this Agreement, except as a result of the Company’s gross negligence, wilful misconduct or bad faith.
The Customer agrees to bear all consequences and responsibilities to ensure that all materials given to the Company do not infringe any copyrights, trademarks, patents or Licensing Legal requirements, and the Customer will indemnify, defend and hold harmless against the Company, including its officers, directors, employees, affiliates, licensors, suppliers, information providers & agents from & against all losses, claims, liabilities, expenses, damages & costs, including reasonable lawyer’s fees, resulting from the use of the materials.
The Customer releases, discharges, and agrees to hold harmless the Company, the Company heirs, legal representatives and assigns, and all persons acting under the Company's authority or those for whom he/she is acting, for any delays in the delivery of the Content, shall the Customer fail to provide the materials required for its completion in a timely manner as stipulated by the Company.
The Customer shall inform the Company of any defects or discrepancies found in the Content within 7 days after collection/delivery/download. The Company reserves the right to dispose the Content without compensation to the Customer if the Customer fails to collect, purchase or download them within 6 months after the Event Date.
All Content will be deleted/disposed at the Company's sole discretion one month after the collection/delivery/download of the Content.
The Customer affirms that he is at least 18 years of age and competent to agree to this release. If the subject is a minor, I hereby warrant that I am the legal guardian of the minor and have the full authority to execute this release on their behalf.
The Customer agrees that in the event the Company fails to provide any or all of its services under any circumstances, or if any of its services is disrupted due to technical fault of its equipment resulting from non-negligent causes or mishaps, the Customer is entitled a refund for services unfulfilled where the value of the refund does not exceed the total value of this contract, and shall be relative to the good will gestures or promotional rates given at the date of Booking.
Where Transfers services are provided by third party, the Customer agrees that prevailing late or cancellation charges of SGD$10 apply.
